1. About Who's Pooling
Who's Pooling (“the Service”, “we”, “us”) is a free coordination tool for private-event carpools that helps event organizers and attendees arrange shared rides.
Important:Who's Pooling is a coordination platform only. We do not provide transportation services, employ drivers, dispatch vehicles, or participate in any actual ride or journey. We simply help people find each other and organize private-event carpools voluntarily.
2. Acceptance of Terms
By accessing or using Who's Pooling, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We may update these terms from time to time. Continued use after changes constitutes acceptance of the revised terms.
3. User Responsibilities
You agree to:
- Provide accurate information about yourself, your vehicle, and your plans
- Drive safely and comply with all applicable traffic laws
- Treat other users with respect and courtesy
- Not use the Service for any unlawful purpose
- Not impersonate another person or misrepresent your identity
- Not use the Service to solicit payment for rides (ride coordination must be voluntary cost-sharing, not commercial transportation)
- Communicate promptly with ride-mates about changes to plans
- Only join or offer rides with people you know and voluntarily choose to travel with
- Accept full personal responsibility for your conduct, travel decisions, and legal compliance during any trip
4. No Transportation Liability
Who's Pooling is a coordination tool only. We are not a transportation company, rideshare service, or transportation network company (TNC). We do not:
- Screen, background-check, or vet drivers
- Verify that vehicles are insured or roadworthy
- Monitor or supervise any actual ride journey
- Guarantee the safety, reliability, or quality of any ride arrangement
You use the Service and participate in any ride entirely at your own risk. We strongly encourage all users to exercise independent judgment, share rides only with people they are comfortable with, and ensure that any vehicle used for ride coordination has appropriate insurance coverage. By using ride features, you acknowledge that participant actions are outside our control and that Who's Pooling is not responsible for rider or driver conduct during trips.
5. Free Service & Sponsor Support
Who's Pooling is free to use for organizers and attendees. The Service is supported by sponsors and may display sponsor acknowledgements or promotional messages. We do not charge users for core ride coordination features and intend to keep core functionality free. We reserve the right to introduce optional premium features in the future with advance notice.
6. Account Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms of Service or if we determine your use poses a risk to other users or the platform. You may delete your account at any time by contacting us at hello@whospooling.com.
7. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or free of harmful components. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Who's Pooling and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or any ride arranged through it, including but not limited to personal injury, property damage, or data loss, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from use of the Service shall not exceed $100 USD.
9. Governing Law
These Terms of Service are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these terms or your use of the Service shall be resolved in the state or federal courts located in Santa Clara County, California, and you consent to the personal jurisdiction of such courts.
